These Terms of Service (“Terms”) govern your access to and use of the website at enginethatcould.com, the services offered through it, and any related content, community, or coaching engagements (collectively, the “Services”).

1. Acceptance of These Terms

By accessing the site, booking a session, joining the community, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Who We Are

The Services are provided by Daniel Ehrlich, doing business as “Engine That Could” (“we,” “us,” “our”), reachable at:

3. The Services

  • Informational content about Daniel Ehrlich and the forthcoming book Focus Forward: Decision Making Secrets Learned Beyond Life’s Limits (expected 2027);

  • A decision-making quiz and related follow-up notes;

  • Coaching engagements, including the “Clarity Session” and any related programs, booked through our scheduling provider and paid via our payment processor;

  • Speaking engagements, keynotes, and workshops (booked by separate agreement);

  • Links to third-party platforms we use, including our Substack publication, our Skool community, Cal.com (scheduling), and Stripe (payments).

4. No Professional Advice

Coaching is not therapy, counseling, medical, psychological, psychiatric, legal, tax, or financial advice. The Services are educational and informational only.

  • Nothing on this site, in a session, in the book, or in our content diagnoses, treats, or cures any medical or mental-health condition.

  • If you are experiencing a crisis or need clinical care, contact a licensed professional or emergency services. We are not a substitute for them.

  • Decisions you make based on the Services are your own, and you are solely responsible for them and their consequences.

5. No Guaranteed Outcomes

We provide frameworks, coaching, and content in good faith, but we do not guarantee any specific result — financial, personal, professional, or otherwise. Any testimonials or examples reflect individual experiences and are not a promise of what you will achieve. Individual results depend on factors outside our control.

6. Eligibility

  • The site and its free content may be used by anyone able to form a binding agreement.

  • Purchases and coaching engagements are intended for individuals 18 or older. Minors may participate only with verifiable consent from a parent or legal guardian.

  • By purchasing or booking, you represent that you meet the applicable eligibility requirements.

7. Intellectual Property

All content on the site and in the Services — including text, articles, essays, the book, frameworks, quizzes, branding, and logos — is owned by Daniel Ehrlich or its licensors and is protected by copyright and other intellectual-property laws.

  • You may view and share site content for personal, non-commercial purposes with attribution.

  • You may not copy, republish, sell, distribute, or create derivative works from our content without prior written permission.

  • Coaching materials provided to you in a paid engagement are licensed for your personal use and may not be redistributed or resold.

8. Payments, Fees, and Cancellations

  • Fees for coaching and other paid Services are as displayed at checkout or in your booking confirmation.

  • Payments are processed by Stripe through our scheduling provider (Cal.com). We do not store your payment card details.

  • Taxes, where applicable, are calculated and added at checkout.

  • Coaching sessions are non-refundable once delivered. To reschedule or cancel a booked session, contact us at least 24 hours before the scheduled time. Cancellations with less than 24 hours’ notice, and no-shows, are charged in full. Multi-week programs may be eligible for a prorated refund of undelivered sessions at our discretion.

9. Third-Party Services and Links

The Services integrate with and link to third-party platforms we do not control, including but not limited to Cal.com (scheduling), Stripe (payments), Substack (our newsletter), and Skool (our community). Your use of those platforms is governed by their own terms and privacy policies, not these Terms. We are not responsible for the availability, content, or practices of third-party services.

10. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms;

  • Impersonate any person or entity, or misrepresent your affiliation;

  • Attempt to gain unauthorized access to the site, our systems, or other users’ accounts or data;

  • Upload or transmit malicious code, or interfere with the operation of the Services;

  • Harvest, scrape, or otherwise collect data about other users without consent;

  • Harass, abuse, or harm other users or our team.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, Daniel Ehrlich (Engine That Could) and its affiliates, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services — whether based on contract, tort, negligence, or otherwise — even if advised of the possibility of such damages.

To the fullest extent permitted by law, our total aggregate liability to you for all claims arising out of or related to the Services will not exceed the greater of (i) the amount you paid us in the twelve (12) months preceding the claim, or (ii) one hundred U.S. dollars ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the limitations above may not apply to you to the extent prohibited by applicable law.

13. Indemnification

You agree to indemnify and hold harmless Daniel Ehrlich (Engine That Could) and its affiliates, contractors, and licensors from any claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your violation of these Terms, or your violation of any third-party right.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. You and we agree to submit to the personal jurisdiction of the state and federal courts located in Florida for any dispute arising out of or relating to these Terms or the Services.

15. Dispute Resolution

  • Informal resolution first: Before filing any claim, you agree to contact us at daniel@atasophy.org and give us at least thirty (30) days to attempt to resolve the dispute informally.

  • Judicial resolution: If we cannot resolve the dispute informally, it will be resolved exclusively in the courts identified in Section 14.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date on this page. Your continued use of the Services after a change constitutes acceptance of the revised Terms.

17. Termination

We may suspend or terminate your access to the Services, in whole or in part, at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms or is harmful to us or other users.
